Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of Iron & Tonic (the “Service”), operated by GitPush L.P., Agiou Spiridonos 2, 14121 Athens, Greece (“we”, “us”, or “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
These Terms form a binding agreement between you and GitPush L.P. when you register for an account, access the app, or otherwise use the Service. Where applicable, they are supplemented by our Privacy Policy and Cookies Policy, which are incorporated by reference.
2. Eligibility
You must be at least 16 years old to use Iron & Tonic. By registering you confirm that you meet this requirement. If we discover that an account belongs to someone under 16 we will suspend or delete it without notice.
3. Account registration and access
To access the Service you must create an account with a username and password, or sign in via Google. You are responsible for keeping your credentials secure and for all activity that occurs under your account.
New accounts are immediately active but require a paid subscription (or other qualifying access such as a club membership) to use the app’s features. See section 12 for subscription terms. If you registered through a trainer’s club invite link, your account receives full access as a club member for as long as the club membership is active and the trainer’s subscription covers the seat.
You agree to provide accurate information and to update it if it changes. We may refuse, suspend, or terminate accounts at our discretion.
4. Description of the Service
Iron & Tonic is a workout and nutrition tracking application. It currently comprises:
- Iron — workout logging: record exercises, sets, reps, weight, and track progress over time.
- Tonic — nutrition logging: log meals, track macronutrients, and monitor daily intake against a macro plan.
- Coach — an AI assistant that answers nutrition and training questions based on your logged data. See section 10 for important limitations.
- Clubs — a feature for personal trainers to group their clients and share routines. See section 9.
The Service also integrates with third-party platforms (see section 11).
5. Beta status and “as-is” provision
Iron & Tonic is currently provided in beta. This means:
- Features may change, be added, or be removed at any time without notice.
- We make no guarantee of uptime, data durability, or uninterrupted access.
- The Service is provided “as is” and “as available”, without any warranty of fitness for a particular purpose or merchantability, to the fullest extent permitted by applicable law.
We will try to give reasonable notice before making breaking changes or shutting down the Service, but cannot guarantee this during beta.
6. Acceptable use
You agree to use the Service only for its intended purposes and in compliance with applicable law. You must not:
- Use the Service to store or transmit content that is unlawful, harmful, abusive, or infringes third-party rights.
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
- Reverse-engineer, decompile, or scrape the Service in ways that violate our intellectual property rights.
- Use automated tools to send requests at a volume that places unreasonable load on our servers.
- Impersonate another person or entity.
- Use the Service in a way that could harm other users.
Breaches of this section may result in immediate account suspension or termination.
7. User content
You own the content you create in the Service, including your workout logs, meal diary entries, measurements, goals, and routines (“User Content”). We do not claim ownership of your data.
By using the Service you grant us a limited, worldwide, royalty-free licence to store, process, and display your User Content solely as necessary to operate and improve the Service. This licence ends when you delete your account or the relevant content, subject to retention obligations required by law.
You are responsible for ensuring that any content you enter is accurate and does not infringe third-party rights.
8. Meal photos
When you use the food-scan feature to analyse a meal from a photo, the image is sent to our AI provider for analysis and is never stored on our servers. Photos are processed transiently and discarded immediately after the analysis response is returned.
9. Clubs and trainer relationships
Trainers with a trainer subscription can create a Club and invite clients to join via an invite link. Joining a Club grants the trainer read access to your activity within the app and the ability to share routines with you.
A Club is a permission relationship, not ownership of your account or data. If you leave a Club—or if a trainer removes you—your account and all your logs remain yours. The trainer loses access to your data when the membership ends.
We are not a party to any personal-training or coaching arrangements between trainers and their clients and accept no liability for the content of that relationship.
10. AI output — not medical or dietary advice
The Coach feature, macro-target suggestions, and automated meal-nutrition estimates are generated by an AI model and are provided for informational and convenience purposes only. They do not constitute medical advice, dietary advice, health advice, or professional nutritional guidance of any kind.
You must not rely on AI-generated content for any medical decision, diagnosis, treatment, or change to a prescribed diet or medication regimen. Always consult a qualified healthcare professional, registered dietitian, or other appropriate specialist before making decisions that affect your health.
AI models can produce inaccurate or incomplete output. We do not warrant the accuracy, completeness, or suitability of any AI-generated content and accept no liability for reliance on it.
11. Third-party services
The Service integrates with the following third-party providers. Use of these integrations is subject to their respective terms and privacy policies:
- Stripe — payment processing and subscription management. Your payment details are collected and held by Stripe; we do not store card numbers or full payment credentials.
- Google — optional sign-in via Google OAuth. Governed by Google’s Terms of Service and Privacy Policy.
- Garmin — optional integration with Garmin Connect to sync training-readiness and body-battery metrics and to push workouts. Governed by Garmin’s Terms of Service.
- Moonshot / Kimi — AI provider used to power the Coach feature and automated meal analysis. Prompts and relevant context are sent to their API; see our Privacy Policy for details.
We are not responsible for the availability, accuracy, or conduct of any third-party service.
12. Subscriptions, payment, and cancellation
Access to Iron & Tonic requires a paid subscription, processed via Stripe. The following terms apply:
- Free trial. New Stripe customers receive a 3-day free trial with a valid payment method required at sign-up (card-upfront trial). The trial is granted once per Stripe customer; a second Checkout with the same Stripe customer record starts a paid subscription immediately with no trial period.
- Billing cycle. Subscriptions are billed monthly. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Managing your subscription. You can manage, pause, or cancel your subscription at any time through the Stripe-hosted customer portal accessible from your account settings. Cancellation takes effect at the end of the paid period.
- Refunds. Refunds are not provided for unused portions of a billing period, except where required by applicable law.
- Trainer (per-seat) subscriptions. Trainers are billed per club member on a monthly seat plan. Seat counts are updated automatically as members join or leave the Club and are billed accordingly.
13. Suspension and termination
We may suspend or terminate your account if you breach these Terms, if we receive a valid legal order, or at our reasonable discretion with reasonable prior notice where practicable.
You may request deletion of your account by emailing us at [email protected]. There is no automated self-service deletion in the app at this time; deletion requests are handled manually. On deletion, your data will be removed in accordance with our Privacy Policy.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) continue to apply after any termination.
14. Limitation of liability and indemnity
To the fullest extent permitted by Greek law, GitPush L.P. and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of profits, arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or €50, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud, or any other liability that cannot be excluded under mandatory Greek law.
You agree to indemnify and hold harmless GitPush L.P. from any third-party claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Service in violation of applicable law.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where practicable, notify you by email or in-app notice. Continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
16. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Greece, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.
